利用規約

規約本文: 第1条　（基本的事項の遵守）
利用者は、本システムご利用に際し、インターネット利用の一般的なマナーやモラル、および技術的ルールを遵守するものとします。

第2条　（基本的事項に反する場合の措置）
当館は、第三者に迷惑、不利益、危害を与える等の行為、当館のサービスに支障を来す恐れのある行為等、当館が不適当と判断する行為を行う利用者には、本システムおよび当館の利用をお断りすることができるものとします。

第3条　（利用環境）
1. 利用者は、本システム利用に際して必要となるパソコンまたは携帯電話等の日本語もしくは英語によるインターネットWebサイトの閲覧及び電子メールの利用環境、通信環境を、自己の責任と負担において整えているものとし、当館は利用者の利用環境に起因するいかなる影響、損害に対しても一切の責任を負わないものとします。
2. 本システム利用に関わる通信料、接続料等一切の費用は利用者の負担とします。

第4条　（本システム利用の条件）
1. 利用者は本規約に従い、本システムを利用するものとします。
2. 利用者は本システムを利用することにより、本規約の全ての内容に同意したものとみなされます。

第5条　（利用者の自己責任）
1. 利用者は、利用者自身の自己責任において本システム利用するものとし、自ら行った一切の行為およびその結果について、利用者自身の行為、過失の有無を問わず、利用者はその責任を負うものとします。
2. 本システム利用により利用者が第三者に損害を与えた場合、当館の過失に依る場合を除き利用者は自己の責任と負担において当該第三者との紛争を解決するものとします。

第6条　（禁止行為）
1. 利用者は、本システムの利用にあたって、次に掲げる行為またはその恐れがある行為を行ってはならないものとします。
(1) 本システムを不正な目的をもって利用する行為
(2) 犯罪に結びつく行為
(3) 当館または第三者の著作権、商標権等の知的財産権、肖像権若しくは財産を侵害する行為、あるいは侵害する恐れのある行為。
(4) 来館予約に当たって、虚偽または不正な情報を入力する行為
(5) 有料の手配代行等、営利を目的として本システムを利用する行為
(6) 第三者に成りすまして本システムを利用する行為
(7) 有害なコンピュータープログラム等の送信または書き込みを行う行為
(8) 法令、本規約もしくは公序良俗に違反する行為
(9) 本システムの運営を妨害する行為
(10) その他当館が不適切と判断する行為
2. 利用者が本規約に違反することにより、当館および本システムに損害を与えた場合、当館は利用者に対して被った全ての損害の賠償を請求できるものとします。

第7条　（システム及び規約の変更等）
当館は、本システムまたは本規約を当館が必要であると判断した場合、事前に利用者に通知することなく変更、中断、終了することができるものとします。本規約変更後は、本システムに関する一切の事項は変更後の規約によるものとします。

第8条　（本システムの停止）
当館は、次のいずれかに該当する場合、利用者への事前の通知なしに本システムの一部または全部を停止できるものとします。
1. 本システムの保守、点検または改修を行う場合
2. 天災事変、戦争、暴動、内乱その他の非常事態が発生し、または発生する恐れがあり、本システムの運営が困難となった場合。
3. 当館がホームページおよび本システムの運営上、本システムの停止が必要と判断した場合。

第9条　（個人情報の取扱い）
当館は、本システムの利用により入手した利用者の個人情報を、別に定める「プライバシーポリシー」に基づき適切に取扱うものとします。

第10条　（準拠法・管轄裁判所）
1. 本利用規約の解釈、適用は日本国法に準拠するものとします。
2. 本システム利用に関して利用者と当館間に紛争が生じた場合には、当館が別に定める裁判所を第一審の専属的合意裁判所として当該紛争を解決するものとします。

第11条　（本規約の発効）
本規約は、日本標準時2018年10月1日より有効とします。

Terms of Use of Internet Reservation System

The Nippon Mining Museum (hereinafter “the Museum”) provides for the following Terms of Use (hereinafter “the Terms”) regarding the use of the Internet Reservation System (hereinafter “the System”).

Article 1 (Observance of rules on basic matters)
In using the System, users shall abide by general manners and morals as well as technical rules on the use of the Internet.

Article 2 (Measures against violation of rules on basic matters)
The Museum shall be authorized to deny the use of the System and the Museum by users who commit acts which the Museum deems as inappropriate, including acts which cause trouble, detriment, harm, etc. to third parties and acts which may interfere with the Museum’s services.

Article 3 (Environment for use)
1. Users shall create an environment for using the System including personal computers and cell phones, on their own responsibility and at their own expense, to enable browsing of Internet websites and e-mail communication in Japanese or English. The Museum shall not be held responsible for any effect and/or damage originating from the communication environment of users.
2. Users shall bear all expenses, including communication charges and connection fees, involved in the use of the System.

Article 4 (Terms of use of the System)
1. Users shall use the System in accordance with the Terms.
2. Users shall be deemed to have agreed to all contents of the Terms by using the System.

Article 5 (Self-responsibility of users)
1. Users shall use the System on their own responsibility and shall be held accountable for all of their acts and their results, regardless of their own acts or not, with or without negligence.
2. Should a user inflict damage on a third party or parties by using the System, the user shall resolve any dispute with the said party or parties on his/her own responsibility and at his/her own expense except when the Museum’s negligence is to blame.

Article 6 (Prohibited acts)
1. Users shall not conduct the following acts or acts that may lead to the said acts in using the System.
(1) Any act to use the System for unfair purposes
(2) Any act leading to crime
(3) Any act which infringes or may infringe on the Museum’s or a third party’s intellectual property rights such as copyrights and trademarks, portrait rights or property rights
(4) Any act to enter false or unfair information in booking a visit to the Museum
(5) Any act to use the System for the purpose of profit such as reservation for a fee on behalf of a third party
(6) Any act to use the System under the disguise of a third party
(7) Any act to send or write harmful computer programs, etc.
(8) Any act contrary to laws and regulations, the Terms or public order and good morals
(9) Any act obstructing the operation of the System
(10) Any other act deemed as inappropriate by the Museum
2. Should a user inflict damage on the Museum or the System by breaching the Terms, the Museum shall be allowed to demand compensation of whole damages against the user.

Article 7 (Changes, etc. in the System & Terms)
The Museum shall be allowed to alter, suspend or end the System or the Terms, as deemed necessary by the Museum, without prior notice to users. After the Terms are altered, all matters related to the System shall be subject to the altered Terms.

Article 8 (Suspension of the System)
The Museum shall be allowed to suspend the System in whole or part without prior notice to users in case of the following.
1. When maintenance, inspection or repair is conducted on the System
2. When the operation of the System becomes difficult due to the occurrence, or the fear of occurrence, of a natural disaster, incident, war, riot, civil strife or any other emergency
3. When the Museum deems it necessary to suspend the System in operating its website and the System

Article 9 (Handling of personal information)
The Museum shall properly deal with personal information of users obtained through the use of the System in accordance with the “Privacy Policy” laid down separately.

Article 10 (Governing law, competent court)
1. The interpretation and application of the Terms shall be governed by Japanese laws.
2. In case of a dispute arising between a user and the Museum regarding the use of the System, the said dispute shall be resolved by designating a court specified separately by the Museum as the exclusive jurisdictional court by consent of first instance.

Article 11 (Effectuation of the Terms)
The Terms shall take effect on October 1, 2018, Japan standard time.
